பிடிவாதம் நீடித்தால் கர்நாடகா அரசு டிஸ்மிஸ் செய்யப்படலாம்: சட்ட வல்லுநர்கள் கருத்து

பெங்களூர்: உச்சநீதிமன்ற உத்தரவை மதிக்காமல் தமிழகத்துக்கு காவிரி நீரை திறந்துவிட மறுத்து வரும் கர்நாடக அரசு கலைக்கப்பட்டு மாநிலத்தில் குடியரசுத் தலைவர் ஆட்சியை அமல்படுத்தக் கூடிய வாய்ப்புகள் இருப்பதாக சட்ட வல்லுநர்கள் எச்சரித்துள்ளனர். இந்த எச்சரிக்கையை விடுத்திருப்பதும் கூட கர்நாடக மாநில அரசின் முன்னாள் தலைமை வழக்கறிஞர் அசோக் ஹரனஹள்ளிதான்!
தமிழகத்துக்கு அக்டோபர் 15-ந் தேதி வரை 9 ஆயிரம் கன அடிநீரைத் திறந்துவிட வேண்டும் என்று உச்சநீதிமன்றம் கடந்த 28-ந் தேதி உத்தரவிட்டது. ஆனால் நேற்று இரவு முதல் திடீரென காவிரியில் நீர் திறப்பதை கர்நாடக அரசு நிறுத்திக் கொண்டது. இதையடுத்து கர்நாடகா அரசு மீது தமிழகம் நீதிமன்ற அவமதிப்பு வழக்கு தொடர முடிவு செய்திருக்கிறது.
இதனிடையே கர்நாடகத்தின் இத்தகைய அடாவடித்தனமான நடவடிக்கையை அம்மாநிலத்தின் முன்னாள் அரசு தலைமை வழக்கறிஞர் அசோக் ஹரனஹள்ளியும் கடுமையாக விமர்சித்திருக்கிறார்.
இது தொடர்பாக அவர் கூறியுள்ளதாவது:
கர்நாடக அரசு மேற்கொண்டிருக்கிற இந்த கடும் நடவடிக்கையால் உச்சநீதிமன்றத்தில் நடைபெற உள்ள அடுத்த கட்ட விசாரணையின் போது கர்நாடகத்துக்கு மேலும் சிக்கல் ஏற்படும். கர்நாடகத்துக்கு எதிராக உச்சநீதிமன்றத்தை தமிழக அரசு நாடும்போது அரசியல்சாசன சிக்கல் ஏற்படும். கர்நாடக முதல்வர் மீது நீதிமன்ற அவமதிப்புக்கான நடவடிக்கையை உச்சநீதிமன்றம் மேற்கொள்ளலலாம். மேலும் கர்நாடக அரசு தொடர்ந்தும் பிடிவாதம் காட்டினால் மாநில அரசைக் கலைத்துவிட்டு குடியரசுத் தலைவர் ஆட்சியை அமல்படுத்த பரிந்துரைக்கும் வாய்ப்பும் இருக்கிறது என்று அவர் எச்சரித்துள்ளார்.
The Supreme Court on Monday deferred hearing of the dispute between Tamil Nadu and Karnataka over sharing of the Cauvery water till the Cauvery River Authority takes a call on Karnataka’s plea to review its decision asking it to release 9,000 cusecs of water to Tamil Nadu.
